General Terms and Conditions

1. Definitions

1.1. The BUMBAGR online store is managed and owned through the website www.bumbagr.com (hereinafter referred to as the “Site”) by BUMBAGR S.R.L., headquartered at Str. Mos Ion Roata, nr. 1, bl. 11F, sc. B, ap. 21, Ploiesti, Prahova County, Romania, Unique Registration Code (CUI) 40368207, Trade Register Registration No. J29/19/03.01.2019.

1.2. Throughout this document, the following terms shall have the meanings defined below:

“Seller”: BUMBAGR S.R.L., with the identification details specified in section 1.1.

“Buyer”: any natural or legal person, or any other legal entity that accesses the Site and places an Order.

“Goods and Services”: any product or service featured on the Site, including those mentioned in the Order, to be provided to the Buyer by the Seller.

“Specifications”: all specifications and/or descriptions of the Goods and Services as stated on the Site and in the Order.

“Order”: an electronic document acting as a form of communication between the Seller and the Buyer, through which the Seller agrees to deliver Goods and Services, and the Buyer agrees to receive and pay for them.

“Contract”: the Order confirmed by the Seller through the issuance of a tax invoice or a shipping notification. The contract is not concluded upon the mere placement of the Order or the receipt of the automated confirmation email.

1.3. By accessing, using the Site, or purchasing Goods and Services, you express your full consent to the provisions of this document and the Privacy Policy (GDPR), which forms an integral part hereof.

2. Amendments to Terms and Conditions

The Seller reserves the right to modify these Terms and Conditions at any time without prior notice. Changes become binding and take immediate effect upon publication on the Site. If you do not agree with the modifications, please stop using the Site.

3. Contractual Documents

By placing an Order, the Buyer agrees to the form of communication (email/phone) through which the Seller conducts business operations. The automated order receipt confirmation does not constitute a firm acceptance of the Order and does not mean the conclusion of the distance contract.

The distance contract is concluded when the Seller sends the shipping/delivery notification via email. The Buyer may cancel an Order before receiving the shipping notification by emailing contact@bumbagr.com.

4. Intellectual Property Rights

The entire content of www.bumbagr.com (including texts, images, logos, design, graphics) is the exclusive property of BUMBAGR S.R.L. and is protected by copyright laws. Any copying, reproduction, or use for commercial purposes without prior written consent from the Seller is strictly prohibited.

5. Prohibited Conduct

5.1. It is strictly forbidden to: copy or disassemble the source code, use bots, data mining systems, or similar data collection technologies, use the Site for purposes other than personal/legitimate commercial purchase, or impersonate other individuals.

5.2. In case of violation, the Seller reserves the right to immediately block access to the user account, without limiting BUMBAGR S.R.L.’s right to pursue legal remedies for damages.

6. Account Registration

Creating an account on the Site requires a valid email address and enabling cookies in your browser. The Buyer declares that the provided data is accurate and complete and is fully responsible for maintaining password confidentiality. If you suspect your account safety has been compromised, you must notify us immediately.

7. Ordering Process

To order, browse the categories, select your desired products, click “Add to Cart”, review the items in your shopping cart, fill in the billing and shipping details (via “Proceed to Checkout”), and confirm the order. You will receive email updates followed by the tax invoice (sent digitally and/or included in the package).

8. Prices and Payment Methods

8.1. All prices on the Site are displayed in LEI (RON) and include 19% VAT. Prices do not include shipping costs, which will be calculated and displayed distinctly during checkout.

8.2. Accepted Payment Methods:

Cash on Delivery (Ramburs): Cash payment paid to the courier upon delivery (available in Romania).

Online by Credit/Debit Card: Payments are processed securely via our partner EuPlatesc.ro (using the 3D Secure portal). Card details are not stored or accessed by the Seller.

Warning: Neither BUMBAGR S.R.L. nor the payment processor will ever ask for your PIN or security code (CVV/CVC) via email or phone.

9. Invoicing

The Seller will issue a tax invoice based on the details provided by the Buyer. The invoice will be delivered electronically via email and/or directly inside the shipping package.

10. Shipping and Delivery

10.1. The Seller ships across Romania via fast courier (FUN Courier).

10.2. Shipping rates: 15 LEI for Bucharest and 17 LEI for the rest of the country (standard courier coverage zones).

10.3. The courier will attempt delivery twice. If the package cannot be delivered due to the Buyer’s fault, the order will be canceled. To place a new order, the Seller reserves the right to request advance payment for the previous round-trip transport costs in addition to the new delivery fee.

11. Right of Return and Product Exchange

11.1. According to GEO no. 34/2014, the Buyer (natural person) has the right to withdraw from the contract (return) without penalties and without giving any reason within 14 calendar days from the physical receipt of the products.

11.2. The Buyer may request a product exchange (different size/color) within 14 calendar days. If the new item is more expensive, the Buyer will pay the difference.

11.3. All shipping costs for returns or exchanges are fully covered by the Buyer.

11.4. If the return/exchange is caused by the Seller’s error (wrong item sent, defective product, incorrect specifications), the shipping fees will be paid by the Seller.

11.5. Return Conditions: Products must be returned in their original condition, unworn, unwashed, with no traces of perfume or wear, with all tags intact, and in the original packaging. Otherwise, the Seller reserves the right to refuse the return or deduct a fee for product value depreciation.

11.6. Repetitive and unjustified return requests will be considered an abuse, and the Seller reserves the right to temporarily or permanently block the user account.

12. Account Deletion

Your account can be deleted upon explicit request via email at contact@bumbagr.com or by the Seller if you breach the provisions of this document.

For any questions, support, or complaints regarding our services, please contact us at contact@bumbagr.com. We aim to resolve all inquiries as quickly as possible.

14. Governing Law and Disputes

This document is governed by Romanian law. Any disputes arising between the Seller and the Buyer shall be resolved amicably. If an amicable solution cannot be reached, the dispute will be submitted to the competent Romanian courts.
